In a special sitting in January 2005, Parliament approvedthe amendments to the Ninth Schdule of the Federal Constitution to transfermatters related to WATER SUPPLIES AND SERVICES from the State List to theConcurrent List (except for Sabah and Sarawak). The amendments were gazetted on10th February 2005 and the enforcement date was 21st March 2005. With theamendments, the Federal Govenrment will regulate the water services industry interms of licensing and regulating water services operators. The State Govenrmentalso retains the power to declare and regulate water resources, water catchmentareas and river basins.
The Suruhanjaya Perkhidmatan Air Negara (SPAN) or theNational Water Services Commission is the national regulatory body for thewater and sewerage industry for the Peninsular Malaysia and Wilayah PersekutuanLabuan. The Commission operates under a legislative framework defined in theSuruhanjaya Perkhidmatan Air Negara Act 2006 (Act 654) and the Water ServicesIndustry Act 2006 (Act 655).
